1. KIPO held a meeting of the vice commissioners of the IP5.

- As the presidency of a meeting of the commissioners of IP5 to be held in June 2024 in Seoul, KIPO coordinated, in advance, the agenda of the meeting.
- Subjects to be discussed will be: response to new technology, construction of user-friendly system, realization of sustainable development goals (SDGs), etc.

On April 9, 2024 KIPO published that it would hold a video conference of the ¡®meeting of the vice commissioners of IP5¡¯ to coordinate, in advance, the agenda of the meeting of the commissioners of IP 5 (KIPO, EPO, JPO, CNIPA and USPTO) to be held in June in Seoul.
This meeting will be held to in advance coordinate the agenda of the 2024 meeting of the commissioners of IP 5 including KIPO as the presidency of the meeting, from June 18 (Tuesday) to June 20 (Thursday), in Seoul. About 60 people including the vice commissioners of IP5 and high-level officials of WIPO will attend this meeting.
In the meeting of the vice commissioners of IP5, they will discuss a plan to construct user-friendly global IP system, such as international patent transfer, etc., a plan to respond to IP environment changes due to the advent of the new technology, such as AI, etc., and a plan to realize sustainable development goals (SDGs) in the IP area.


The vice commissioners of IP5 will review issues which were discussed in a working meeting of each IP5 over the last year, to construct user-friendly global IP systems. Especially, the task, an ¡®international patent transfer¡¯, (to be led by KIPO and USTPO) will be discussed. The international patent transfer means that, if a request for patent transfer is submitted once, the effect of transfer of the relevant patent right is collectively approved in all of IP5, to save cost and time of a patentee overseas.


The meeting of the vice commissioners of IP5 will cover the current status of the roadmap of new emerging technologies/AI (NET/AI Roadmap) of IP5, which was established under KIPO leadership in the meeting of the commissioners of IP5 which was held in 2019 in Incheon (Songdo). In this connection, they will share the research results of IP5¡¯s legislation and precedent trends regarding whether to recognize AI as an inventor (¡®Inventorship of AI generated inventions¡¯), which was suggested and approved in the meeting of the commissioners of IP5 which was held in Hawaii, US in 2023. The research results include the inventorship guidance for AI-assisted inventions¡¯ recently published by USTPO according to United States White House executive order of (October 2023)


In the meeting of the vice commissioners of IP5, a detailed IP cooperation plan will be discussed to realize the sustainable development goals (SDGs). In the 2023 meeting of the commissioners of IP5, they agreed to state the ¡®realization of SDGs¡¯ in the IP5¡¯s Vision Statement which was focused on examination cooperation and system harmonization. Accordingly, IP5¡¯s various cooperative basis in the IP area have been prepared to solve humanity¡¯s common problems, such as climate change, etc.


2. South Korea was 1st in ranking the number of patent registrations related to a next-generation display, ¡®micro LED¡¯ technology¡¯.

- Korean companies are leading the technology development in the micro LED field following the OLED field.
- In the top 10, 4 Korean companies ranked including LG Innotek (1st place), Samsung Electronics (2nd), Samsung Display (4th) and LG Display (9th).

# Micro LED is a display technology that each of LED elements under 100§­ directly emits light as an individual pixel. Micro LED is manufactured to be thinner that LCD or OLED and individually controls the light of LED element to realize a fine contrast. Unlike OLED using an organic material, micro LED has no deterioration of picture quality or no burn-in (afterimage) phenomenon and it has low power consumption, long lifespan and fast response speed. Thanks to these advantages, micro LED has been noticed as a next-generation display following LCD and OLED.

In the field of a micro LED which has been noticed as a next-generation display since it is used in various fields, large screen TV, smart devices, etc., South Korea recorded 1st place in world ranking in the number of patent registration, showing that South Korea has lead the technology development in this field.
KIPO analyzed the relevant world patents which were registered in IP5 (KIPO, USPTO, CNIPA, EPO and JPO). As a result, the number of the registered patents for the micro LED technology over the last 10 years (2013~2022) increased nearly by two times, from 540 in 2013 to 1,045 in 2022, with an annual average increase of 7.6%.
By nationality of a registered patentee, South Korea was 1st , 23.2% (1,567 castes), followed by Japan was 2nd, 20.1% (1,360), China was 3rd, 18.0% (1,217), US was 4th, 16.0% (1,080) and EU was 5th, 11.0% (750).
Major registered patentees were: 1st was LG Innoteck (6.0%, 404), 2nd was Samsung Electronics (5.7%, 384), 3rd was Semiconductor Energy Laboratory (SEL) of Japan, 4.7%, 315), 4th was Samsung Display (3.6%, 240), and 5th was BOE Technology of China (3.3%, 223).

As Korean companies, 1st was LG Innotek, 2nd Samsung Electronics, 4th Samsung Display and 9th LG Display. These 4 companies were in the top 10, confirming that Korean companies took a lead in the world micro LED technology.
From the view of the annual average increase rate during the same period, 1st was China (37.5%), 2nd was EU (10.0%), 3rd was Taiwan (9.9%), 4th was South Korea (4.4%) and 5th was US (4.1%). The technological competition is expected to be more fierce between South Korea which had the upper hand in the meantime and China which have actively progressed R&D on the micro LED technology.


3. KIPO starts the activity of 2024 IP policy reporter group!

- KIPO held a launch ceremony of ¡®2024 IP policy reporter group¡¯ for full communication activity.
- Diverse members participating in the IP policy reporter group include students residing at home and overseas, film directors, webtoon writers, etc.

On April 2, 2024, KPO held a ceremony launching the ¡®2024 IP policy reporter group¡¯ to inform people of the IP (patent, trademark, design, etc.) policy, to start full communication activity.
The 2024 IP policy reporter group consists of a total of 15 including students residing at home and overseas, film directors, webtoon writers, etc. They will report the IP policy from people¡¯s perspective and activate public empathy and understanding through communication activity.

The launching ceremony was arranged to increase the reporter group¡¯s overall understanding of IP through ¡ãappointment ceremony ¡ãmeeting ¡ãtour of the hall of inventors ¡ãexperience of a creative invention experience center, etc..
KIPO¡¯s representative spokesperson said that ¡°KIPO will positively support the IP policy reporter group with various experiences and backgrounds such that they can deliver the IP policy in their own interesting and easy manner¡¦and KIPO expects the IP reporter group¡¯s diverse activities.¡±

4. KIPO¡¯s technology police actively starts an investigation of a design copy crime.

- The operation of a ¡®design infringement control support unit¡¯ started on April 1, 2024.

KIPO¡¯s technology design special judicial police (hereinafter, referred to as a ¡®technology police¡¯) announced to fully operate a ¡®design infringement control support unit¡¯ (hereinafter, referred to as a ¡®control support unit¡¯ from April 1, 2024, to rapidly and effectively respond to an increase in the number of design infringement crimes through a habitual bulk distribution seller.

Recently, the number of distributions of design imitation products crossing borders through distribution platforms, such as AliExpress, Temu, etc. has increased and the mass distributors¡¯ criminal methods of design infringement have been intelligent and diversified. Therefore, it has been difficult to catch a crime fact with only a traditional investigation based on a report receiving manner.
Especially, since the membership purchase and joint purchase through a distribution platform and a social network service (SNS), to which only wholesale and retail businesspeople can access, restrict general people¡¯s accessibility for purchase, it is not easy for an investigator to secure infringement evidence.
KIPO newly established the control support unit in Korea Intellectual Property Protection Agency, to control day-by-day increasing design infringement acts and to proceed with rapid and accurate infringement investigation. The control support unit plan to act as general purchasers or retail businesspeople in a mass distribution market, ¡ãto always monitor the distribution of design imitation products and ¡ã to get information of investigation-related information, etc. of habitual mass distributors/sellers.
The control support unit¡¯s constant surveillance will be focused on the fields of clothing, fashions, etc. where design infringement would frequently occur. The distribution information of acquired imitation products will be expected to be delivered to KIPO¡¯s technology police, to be used in establishing a control plan of mass producing, selling and distributing peoples, etc.

The imitation products which the control support unit obtained by purchasing activity and the investigation-related information including transaction specifications, etc. will be later secured as infringement evidence, thereby expecting that the investigation progress will be faster.

5. KIPO held a presentation of antibody-drug conjugate (ADC)-related patent analysis results.

- The presentation was to share the ADC patent analysis results and listen to the relevant R&D field.

As part of communication with people¡¯s livelihood, KIPO announced it would hold a presentation of ADC-related patent analysis results.
The presentation was arranged to share, with the research field, the patent analysis results relating to ADC, a next-generation anticancer drug which has been noticed as a future drug in the bio area. About 100 people from pharmaceutical manufacturing companies, bio companies, patent law firms, etc. attended the presentation.
In the presentation, KIPO shared the ADC-related patent trends and the core patent contents which were analyzed through patent big data and listened to the relevant R&D field.
Every year, KIPO has provided private and government R&D institutes with the results of analyzing the major industry-related patent big data, to improve the national R&D efficiency.

The director of the Chemistry and Biotechnology Examination Bureau of KIPO said, ¡°to enhance the efficiency of R&D in the bio and pharmaceutical manufacturing fields which have been raised as the national core technologies, it is very critical to use the results of patent analysis in the R&D stage¡¦We hope that this presentation will be helpful in setting future R&D directions in the Korean ADC field.¡°
