1. KIPO listens to user opinions to develop a digital trial system.
- KIPO held a meeting with a private advisory group consisting of a patent attorney and an information system expert (June 14).
KIPO held a meeting with a private advisory group for development of a digital patent trial system. To establish a trial system suitable for the digital era, KIPO has promoted the establishment of a digital patent trial system applying the latest technology, such as AI, etc., for 3 years (2023~2025).
This meeting was conducted to faithfully reflect the opinions of patent clients as actual users while proceeding with the continuous project of the digital patent trial system which was developed from 2023 as part of active administration. KIPO will listen to diverse opinions relating to the digital patent trial system so as to be improved to easily view documents and evidence by trial case and Documents and evidence and to send documents digitally, too, etc.
Regarding the trial system partially opened at the end of last year, KIPO will also share the users¡¯ experiences during the first half of this year and collect opinions regarding inconveniences, etc. The head of Industrial Property Information Bureau of KIPO said, ¡°it is most important to accurately analyze and design actual users¡¯ needs¡± and ¡°KIPO will build the digital patent trial system that satisfies patent clients by carefully reviewing valuable opinions of the advisory group to be reflected in the development of the system.¡±.
2. A patent examination organization in charge of secondary batteries newly launched (June 13, 2024).
- Preferential examination of secondary batteries, recruitment of private secondary battery experts as patent examiners, completion of secondary battery examination organization package.
On June 13, 2024, KIPO published the launch of a secondary battery examination organization including a total of 3 departments by newly establishing 2 departments and reorganizing 1 department, for rapid and accurate examination of the secondary battery-related technology. A support system of the patent examination package in the secondary battery field has been established to speed up to support a leader in this technology. The package includes the operation of a preferential examination system for a secondary battery-related patent application which has been previously operated (February 19, 2024), the recruitment of a private expert in the secondary battery field as an examiner (May 29, 2024) and the launch of the secondary battery examination organization (June 13, 2024).
The ¡®secondary battery material examination division, secondary battery design examination team and secondary battery control management examination team¡¯, which were newly established, are evaluated as having an examination organization system tailored to the entire ecosystem process of the secondary battery technology. These 3 departments in charge of secondary battery examination consist of a total of 83 people by adding 38 examiners recruited in a private sector to previous 45 examination manpower in the secondary battery field. Previous personnel and new personnel are assigned in the 3 secondary battery-dedicated examination division, to increase both the efficiency of examination and the quality of examination. The secondary battery examination organization has been established through this reorganization, making it possible to rapidly obtain a right so that a stable protection of the secondary battery-related technology is expected to be possible.
The secondary battery technology is considered as the power of an electric vehicle in the carbon neutral era and the essential key to drive a next-generation national industrial development in the next. Together with semiconductors, secondary batteries are also evaluated as an important asset of the Korean economy. Korean major companies, such as LG Energy Solution, SK on, Samsung SDI, etc., are standing out in the global market. Recently, technological competition among major countries has been intensified. The number of patent applications for the secondary battery-related technology sharply increased by an annual average of 13% over the 5 years (2019~2023). To expand the technology leadership through timely securing of patent rights, companies¡¯ requests for rapid examination services have been also increased. Thanks to the results of supporting the semiconductor patent examination package, KIPO expanded support for such a patent examination package in the secondary battery technology. KIPO has a plan to expand support in the other cutting-edge technological fields.
3. The presidents of IP5 Trial and Appeal Boards discussed the impact of AI on patent trials.
- KIPO¡¯s Intellectual Property Trial and Appeal Board (IPTAB) held a high-level meeting of IP5 Trial and Appeal Boards (TAB) (June 11, 2024). - A ¡®patent examination international seminar for conversation with interested parties was held (June 12, 2024).
KIPO¡¯s IPTAB held a 5th high-level meeting of IP5 Trial and Appeal Boards (TAB) (hereinafter, referred to as the ¡®meeting¡¯). In the meeting, they discussed how to use AI and ways to respond thereto in a patent trial. The president of IPTAB of KIPO, the vice chief of TAB of USPTO, the president of TAB of EPO, the director general of TAB of JPO, and the director general of Patent Reexamination and Invalidation Department of CNIPA attended this 5th meeting. The director of WIPO judicial Institute and the director of WIPO International Cooperation Division observed. In the meeting, delegates discussed the patent trial trends, policy directions and issues by institution, trial informatization, and the impact of artificial intelligence (AI) on trials and sought ways to improve trial systems. Especially, in this meeting, they discussed the impact of the use of AI on patent trials as the AI-related issues in patent trials and ways and plans to utilize AI in patent trials as the recent hot topics. The presidents of TABs met the officials in the Korean IP field, such as domestic company representatives, lawyers and patent attorneys, among others, in the ¡®patent trial international seminar¡¯, to share what was discussed in the high-level meeting.
4. Standard patents respond to environmental changes by open policy (governance)!
- KIPO launched a ¡®standard patent research group¡¯ where industry, academia, research institutes, and government participate (June 10, 2024). - Experts from each field gathered to share and discuss policies and issues related to standard patents.
KIPO published to launch a ¡®standard patent research group¡¯ where related industry, academia, research institutes and government participate together. As the new industry, such as connected cars, intelligent home appliances (smart home appliances) has actively appeared due to the convergence of information culture technology (ICT), the influence of standard patents has expanded to all industries. In April 2023, the European Commission (EC) promoted legislation by proposing regulations to secure transparency and predictability of standard patent licensing, so that global standard patent environments have rapidly changed
Therefore, KIPO launched the ¡®standard patent research group¡¯, to respond to standard patent environmental changes with an ¡®open policy (governance)¡¯ by sharing with standard patent experts the domestic and overseas standard patent-related policies and systems and the relevant industry¡¯s major issues and by discussing future policy directions. In the research group, about 20 people including KIPO staff in charge, big companies, small and medium companies, midsize companies, universities, public research institutes and legal experts participate to share opinions from various perspectives. At the first research meeting held along with the launch ceremony, they will deal with topics, such as the standard patent-related regulations proposed by EC in April 2023, and the ways to strengthen standard patent ecosystem to activate creation and utilization of standard patents. The research meeting will be held semiannually to expand the scope of research.
KIPO continues to make efforts to strengthen a national standard patent competitiveness by supporting a public and private research and development (R&D) plan by discovering promising technologies that require preemption of standard patents and by supporting Korean industry, academia and research, which aim to acquire standard technologies, with strategies to secure standard patents.
5. A private sector takes the lead in expanding the patent-based research and development (IP-R&D)!
- KIPO held a 5th IP-based research and development (IP-R&D) council steering committee (May 27, 2024). - KIPO and IP-R&D participant companies discussed ways to operate it and listened to on-site complaints. According to KIPO, a 5th IP-based research and development (IP-R&D) council steering committee¡¯ to spread the IP-based research and development (IP-R&D) led by private sector has been opened to discuss operation plans and to listen to on-site complaints. The IP-based research and development (IP-R&D) council steering committee¡¯ (hereinafter, referred to as ¡®committee¡¯) is a private autonomous council (at present, 105 agencies) formed in April 2024 with companies participating the IP-R&D strategical support program to share and spread the outcome of the program.
¡¼Strategic support for IP-based research and development (IP-R&D)¡½
• A dedicated team consisting of IP strategy experts and IP analysis agencies, etc. supports companies, etc., with consultation customized for their R&D sites.
• The worldwide IP information is analyzed to support to ¨ç set direction of optimal research and development directions, ¨è overcome overseas IP barriers, and ¨é occupy promising patents for patent technology gaps, thereby preventing duplicate research and seek efficiency of R&D.
In this meeting, the committee members including the president of the 5th council launched in November 2023 (vice president of AP System) and the vice president(s) thereof (representatives of A-Life, the director of AETECH), etc. participated to discuss ¡ã ways to operate and develop the council, ¡ã selection of research topics by department, and ¡ã how to improve the systems, etc. After the council was launched in 2014, it established the committee where chief executive officers (CEOs) and the chief technology officers (CTOs) of industry, academia and research participate and the research departments formed of hands-on workers, etc.. Their activities have been focused on studies of IP-R&D methods, suggestions for education and system improvements, etc.
In this year, the committee focuses on operation of the two departments (the IP-R&D research department and the planning and innovation department), to focus on the suggestions for policies from a company perspective and the studies of advancement of IP-R&D methodology. The head of Industrial Property Policy Bureau of KIPO said, ¡°IP-R&D is the means for R&D efficiency which Korean companies can reduce trials and errors in the R&D processes¡± and ¡°KIPO will continue to work with the council such that IP-R&D be spread to research and development fields.¡±
