1. KIPO published a ¡®five-year plan for AI-based intelligent IP net¡¯

The Korean Intellectual Property Office (KIPO) builds a ¡®next-generation smart IP net¡¯ which will replace the present IP net with an AI-based intelligent system applying up-to-date intelligence information technology such as AI, to innovatively improve the quality and efficiency of IP administration and convenience in service for the users.

This year, KIPO will spend 9.8 billion Korea Won to build an AI machine translation system and improve the electronic application filing system to a user-friendly type. KIPO starts the project to improve computing power in April.

¨ç The AI technology will be introduced to rapidly and accurately process the IP administration.

An AI search system will be built so that examiners will be able to more correctly find prior art documents including images, drawings, chemical structures, etc. as well as words.

Further, a switch to a high-quality AI machine translation service will enable for examiners to comprehensively and correctly search the worldwide prior art documents, without language barriers.

¨è The electronic application filing system will be improved to make it easier for people to file patent applications.

A mobile electronic application filing service will be built, making it possible to file an application for a patent, trademark or etc. anytime and anywhere, to view its progress and to pay the relevant official fees by using a smart phone, etc.

A mobile e-filing service for a trademark application will be carried forward in 2019, expanding to mobile e-filing services for a patent application, a utility model application and a design application in 2020.

Further, diverse government standard certification systems including not only certificates but also finger prints, irises, e-mails, etc. will be applied in the electronic application filing services, improving the convenience in accessing the services.

KIPO will also support in rebuilding the electronic application filing services with a web-based system such that people will be able to easily file an application in a simplified form and the system will enable an automatic check regarding whether any prior art exists or various errors, etc. are made upon making the application.

¨é The supply of the patent information DB will be expanded to activate the IP service industry.

Machine translation learning data, patent drawing reference numerals, trademark image characteristic information, etc., which will be greatly useful for IP information service companies to develop AI-based high value-added services, will be processed and built to be shared with the users

In addition, an IP supply service platform (KIPRISPlus) will be more sophisticated so that users will be able to directly search and select diverse data online, to be downloaded in desired formats.

¨ê The system performance will be heightened to stably provide AI services.

The IP net is switched to an open architecture so that the latest technology and open software developed by private sectors will be directly applied to the system and be used.

Data processing resources will be built in high-speed computing environments, to smoothly support AI learning, big data analysis, etc. that require for high-speed processing of an enormous amount of data.


2. The system of requesting cancellation of a patent has been stably settled to be actively used

According to the Korea Intellectual Property Trial and Appeal Board (KIPTAB), the system of requesting the cancellation of a patent, which was introduced in March 2017, has been stably settled to be actively used.

Under the system of requesting cancellation of a patent, when only evidential material is simply submitted within six (6) months after the registration of a patent, a judge will review the patent. The period for submitting evidential material had been previously three (3) months but was extended to six (6) months.

This system is a measure to prevent any disputes, such as an unnecessary patent trial, etc., by allowing anyone to make a request for cancellation of a defective patent at the beginning of registration of the patent.

The number of the requests for patent cancellation, which were filed from March 2017 to February 2019, totals 278 (134 in the first year (March 2017~February 2018) after this system was introduced, and 144 in the second year (March 2018~February 2019).

Of the 103 cases which have been processed, 25 cases (24%) were cancelled patents and the remaining cases were maintained as patents, showing the effect of preventing disputes.


3. KIPO opened an overseas IP center (IP-DESK) in Hong Kong

KIPO and the Korea Trade Investment Promotion Agency (KOTRA) have jointly opened Hong Kong overseas IP center (hereinafter, referred to as ¡°IP-DESK) in charge of Korean companies¡¯ IP protection, in a Hong Kong KOTRA office.

KIPO installed the IP-DESK in the KOTRA overseas offices (14 offices in 8 countries including China, Vietnam, Thailand, etc.), to support Korean companies that have advanced in those places in securing IP rights and reacting to disputes. Since each country has different procedures to register IP rights, such as patents, trademarks, designs, etc., and different laws for IP protection and agencies in charge, the IP-DESKs which are well familiar with situations by countries are greatly helpful to those companies in solving IP issues.

Although Hong Kong is in a top 4th place in ranking the exporting areas of Korean companies (1st: China, 2nd: USA, 3rd: Vietnam and 5th: Japan), an IP-DESK was not available. Further, Hong Kong is the 5th area in the world where Korean small and medium companies have actively advanced and it is the 7th in the world in ranking in the number of IP applications. In these points, the opening of IP-DESK has a very significant meaning.

The Hong Kong IP-DESK has a plan to support Korean companies in customs registration of IP rights for border measures of counterfeit product distribution and in patent, trademark and design applications. Further, considering that many kinds of exhibitions are opened, Hong Kong IP-DESK will provide, through local manpower, strategies to prevent IP disputes related to the participation of exhibitions and to take action against any infringement.
