1. If a registered trademark is not used, it is cancelled¡¦The number of requests for a trademark cancellation trial has increased

According to the Korea Intellectual Property Trial and Appeal Board (KIPTAB), if a registered trademark is not used for three (3) years, it is cancelled.

It is reported that 1,444 registered trademarks were cancelled last year since the owners of the trademarks failed to properly use the trademarks.

KIPTAB announced that the number of requests for a trademark cancellation trial has steadily increased over the last five (5) years (2014~2018).

The number of the cases requesting a trademark cancellation trial increased from 1,449 in 2014, 1,903 in 2015, 2,122 in 2016 and 2,124 in 2017 to 2,523 in 2018. As many as about 1,000 cases (74%) increased in 2018 which was five (5) years in comparison with 2014.

The number of the trademarks cancelled based on nonuse through the decisions of KIPTAB during the same period was 970 in 2014, 1,124 in 2015, 1,207 in 2016, 2,172 in 2017 and 1,444 in 2018.


2. A seminar for online IP protection in China and ASEAN was held

According to the Korean Intellectual Property Office (KIPO), the Korea Intellectual Property Protection Agency (KIPPA), which is a KIPO-affiliated public organization, held a seminar for online IP protection in China and ASEAN.

Chinese Alibaba group and ASEAN Lazada group were invited for the seminar which was arranged to guide IP protection strategies to Korean companies that want to advance in overseas online markets.

The seminar started with a keynote talk regarding ¡°Global online market entry strategies and prospects¡± from Mr. Pierre Poignant, CEO of Lazada group.

In the following session, the participants from Alibaba and Lazada directly explained the major environmental changes in Chinese and ASEAN online markets and the Korean companies¡¯ products preferred by local people.

Further, they guided the IP protection strategies and the procedures to report counterfeit products through the IP report platform operated by Alibaba and Lazada.


3. An online counterfeit product monitoring group, which works in the home, is active

According to KIPO, the online counterfeit product monitoring group working in the home exposed 18,105 cases with counterfeit product distribution posts online, such as open markets, portals, SNS, etc., to stop the relevant sales.

Of 5,557 cases that counterfeit products were reported to KIPO in 2018, the number of cases reporting online counterfeit product distribution was 5,426 reaching 97.6%.

KIPO has newly operated the monitoring group since April 1, 2019 by selecting 110 people, to prevent the distribution of online counterfeit products. The monitoring group consists of all women, to increase the rate of exposing counterfeit products by using the know-how of women, who are familiar to famous trademarks and online shopping, and to help women, who are on career breaks due to childbirth and infant care, in returning to economic activity.

The monitoring group includes 101 women, 91.8%, who are 30s~40s on career breaks due to childbirth and infant care.


4. KIPO published the trends of patent applications by types of medical devices

KIPO published the trends of patent applications filed over the last ten (10) years (2019~2018) by the types of medical devices, to establish the research and development strategies and to support the technical development in the industrial world as part of government innovation.

According to the trends, a total of 76,949 patent applications in the field of medical devices were filed over the last ten (10) years, showing an annual average of 6.82%. The number of the whole patent applications increased by an annual average of 1.3%, whereas, the number of the applications in the field of medical devices exceeded that by more than five (5) times, showing a sharp growth compared with the other industrial fields.

Medical devices could be divided into fourteen (14) technical fields which are: ¨ç medical diagnostic imaging devices, ¨è biometrics, ¨é in-vitro diagnostics, ¨ê medical devices, ¨ë anesthesia breathing devices, ¨ì surgical treatment devices, ¨ítherapeutic aids, ¨î orthopedic supplies, ¨ïdevices for replacing function of internal organ, ¨ðmedical speculums, ¨ñmedical supplies, ¨òdental equipment, ¨órehabilitation aids, ¨ômedical information equipment

Among these fields, the number of patent applications in medical information equipment and biometrics has greatly increased by 20.9% and 16.6%, respectively. The number of the patent applications in medical information equipment was 502 in 2015, 572 in 2016, 531 in 2017 and 1,037 in 2018. The number of the patent applications in biometrics was 1,211 in 2015, 1,379 in 2016, 1,440 in 2017 and 1,630 in 2018.
